This Agreement establishes the terms and conditions governing the relationship between Cestokart and all registered sellers utilizing the Cestokart Marketplace Platform.
These Seller Terms and Conditions govern the relationship between Cestokart, hereinafter referred to as the Company or Platform, and any individual, business entity, or organization, hereinafter referred to as the Seller, who registers, lists, promotes, or sells products through the Cestokart online marketplace platform.
By registering as a seller on Cestokart, you acknowledge that you have read, understood, and agreed to comply with these Terms and Conditions.
Cestokart operates as an online marketplace that enables sellers to list, promote, and sell their products through the Platform. Cestokart may also offer its own products for sale.
Sellers remain solely responsible for the products they list, including their quality, accuracy, legality, pricing, inventory, shipping, delivery, and fulfilment.
To become a seller on Cestokart, you must:
Submission of false, forged, altered, or misleading documents may result in suspension or termination of the seller account.
Cestokart reserves the right to approve or reject any seller registration request without assigning any reason.
Sellers may list their products on the Cestokart platform alongside products offered directly by Cestokart.
The Seller shall ensure that:
Cestokart reserves the right to remove or reject images that do not comply with Platform standards.
The Seller shall maintain accurate and up-to-date inventory records for all products listed on the Platform.
The Seller is responsible for ensuring that stock quantities displayed on the Platform accurately reflect product availability at all times.
Sellers may revise, increase, decrease, or discount product prices at their discretion, provided that all pricing displayed on the Platform remains accurate and lawful.
Cestokart reserves the right to remove, suspend, or edit any listing that violates Platform policies or applicable laws.
Currently, Cestokart does not charge sellers any additional fee for listing products on the Platform.
Cestokart may, at its sole discretion, provide selected sellers with complimentary promotional opportunities, including homepage placement, featured listings, banner advertisements, marketing campaigns, and social media promotions.
Such promotional benefits are not guaranteed and may be provided only to selected sellers or products.
The Seller shall be solely responsible for packaging, dispatching, shipping, tracking, and delivering products to customers.
Sellers must arrange courier and logistics services independently and shall bear full responsibility for delivery performance, delays, damages, losses, or customer claims relating to shipment.
Sellers may apply shipping charges to Online Payment orders, Cash on Delivery (COD) orders, or both, at their discretion. Where no shipping charge is specified, the product shall be deemed to be offered without additional shipping charges.
Cestokart shall not be liable for shipping or delivery issues arising from the Seller's operations.
Cestokart may offer customers multiple payment methods available on the Platform.
Seller earnings shall become eligible for withdrawal only after successful delivery of the product and completion of any applicable verification process.
For every successful order, Cestokart shall retain a platform service fee of five percent (5%) of the total order value. The remaining ninety-five percent (95%) of the eligible amount shall be payable to the Seller.
The minimum withdrawal amount shall be INR 1,000 (One Thousand Indian Rupees). Withdrawal requests below this amount will not be processed.
Cestokart reserves the right to revise its fee structure and payment policies with prior notice.
Cestokart may provide an affiliate feature through which social media influencers, content creators, marketers, or other individuals may promote eligible products listed on the Platform and earn commissions from successful sales.
Participation in the affiliate program shall be determined solely by the Seller. Sellers may choose whether a product is eligible for affiliate promotion and may determine the commission rate payable to affiliates for each eligible product.
Sellers may modify, suspend, or remove affiliate eligibility and commission rates for their products at any time, subject to applicable Platform policies.
Cestokart acts solely as a facilitator of the affiliate feature and shall not be responsible for any agreements, promotional activities, or disputes arising between Sellers and affiliates.
Any complaint, dispute, claim, return request, or concern received from customers regarding a Seller's product or service may be forwarded by Cestokart to the respective Seller.
The Seller shall be solely responsible for addressing and resolving such matters in a timely and professional manner.
The Seller shall bear sole responsibility for all products listed and sold through the Platform.
Sellers shall not:
Violation of this clause may result in immediate suspension or permanent termination of the seller account.
All trademarks, logos, branding materials, website content, and platform technology associated with Cestokart remain the exclusive property of the Company.
Sellers may not use the Cestokart name, logo, trademarks, or branding without prior written permission.
Cestokart functions solely as an intermediary marketplace platform between buyers and sellers.
Cestokart shall not be liable for product defects, seller misconduct, customer disputes, delivery failures, damages, losses, or claims arising from products listed by sellers.
The Seller agrees to indemnify and hold harmless Cestokart from any claims, liabilities, losses, damages, or legal proceedings arising from the Seller's products or activities.
Cestokart reserves the right to suspend, restrict, or permanently terminate any seller account for violations of these Terms and Conditions or activities deemed harmful to the Platform.
Termination may occur without prior notice in cases of fraud, legal violations, misuse of the Platform, or submission of false documentation.
Cestokart reserves the right to amend, modify, or update these Terms and Conditions at any time. Continued use of the Platform following such updates shall constitute acceptance of the revised Terms.
These Terms and Conditions shall be governed and interpreted in accordance with the laws of India.
Any dispute arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the competent courts of India.
